GRIEVANCE PROCEDURES
Lyons School District 103 has formal procedures in place to address complaints of discrimination, harassment, and retaliation.
- Policy 2:260 (Uniform Grievance Procedure): This covers general discrimination and harassment (excluding Title IX sexual harassment).
- Policy 2:265 (Title IX Sexual Harassment Grievance Procedure): This is a specific procedure for complaints of sexual harassment as defined under Title IX.
Key Aspects of Our Grievance Procedures:
- Complaint Manager Role: Our Complaint Managers are dedicated staff members responsible for receiving and addressing complaints related to various forms of discrimination, harassment, and other specified concerns.
- Confidentiality: We keep complaints confidential to the extent possible, balancing privacy with the need for a thorough investigation.
- Timelines for Formal Grievance Process: We are committed to the prompt and equitable resolution of all complaints. "School business days" means days when the District's main office is open. While deadlines may be extended, rest assured that failure to strictly follow these timelines will not negatively affect any party.
- Complaint Manager's Report: The Complaint Manager will provide a written report of their findings to the Superintendent within 30 school business days after the complaint was filed. They may request an extension if needed.
- Superintendent's Decision: The Superintendent will provide a written decision to the Complainant, the accused, and the Complaint Manager within 5 school business days after receiving the Complaint Manager's report. All decisions are based on the "preponderance of evidence" standard.
- Appeal to the Board (if applicable):
- You or the accused can appeal the Superintendent's decision to the Board by sending a written request to the Complaint Manager within 10 school business days after receiving the Superintendent's decision.
- For complaints involving the Superintendent, the Board will provide its written decision within 30 school business days after receiving the Complaint Manager's or outside investigator's report.
- For other appeals, the Board will affirm, reverse, or amend the Superintendent's decision, or direct the Superintendent to gather additional information, within 30 school business days after an appeal of the Superintendent's decision.
